General Restrictions
- Conduct & Behavior – The residential tenants shall maintain the unit in a peaceful and reasonably quiet manner. Each tenant in the unit should refrain from excessive noise, boisterous or loud acts that would disturb their neighbors and the overall peacefulness of the building and its premises.
- Noise in Common Areas – Residential tenants shall to exercise moderation when using electronic devices that emit sound such as musical instruments, televisions, sound systems, and all sound emitting devices
- Gambling in Building – Gambling within the building/property premises is strictly prohibited and will be reported to local authorities for illegal activity.
- Smoking in Building – Smoking of tobacco cigarettes, electronic cigarettes, and the use of other tobacco products is strictly prohibited inside the residential units and common areas. Designated smoking areas will be provided within the building/property premises.
- Prohibited Drugs & Other Illegal Substances – The possession, use, distribution, sale, and abuse of illegal drugs and other substances is strictly prohibited within the building/property premises and shall be reported to local authorities for illegal activity.
- Alcohol in Building – Alcohol sales, distribution, and abuse is strictly prohibited within the building/property premises. Drinking of alcoholic beverages is strictly prohibited in common areas. Consumption of such beverages shall be confined inside residential units.
- Business Activity – Residential tenants shall not be permitted to conduct any business activity within the residential units or the building/property’s surrounding premises.
- Solicitation – Any political, religious, charitable activities, or any kind of solicitation that causes undue disturbance or disorder within the building/property premises is strictly prohibited.
- Cooking in Common Areas – Cooking within the common areas is only allowed in the common area pantry at the ground floor of the building. Cooking or bringing of cooking appliances such as LPG and propane gas burners, induction cookers, and toasters are strictly prohibited.
- Illegal Weapons & Firearms – Keeping of firearms, knives, other dangerous weapons, hazardous & flammable materials inside the building/property premises is strictly prohibited.
- Dusting in Building – Dusting of rugs and other alike from the windows, doors, or in common areas are strictly prohibited.
- Hanging of Clotheslines – Tenants should not hang any permanent or temporary items on any part of the building that exposed to the public view such as clotheslines, laundry, etc. No waste materials should not be allowed to accumulate in any part of the unit or the buildings premises.
- Obstruction of Common Areas – Tenants shall not restrict or obstruct any entrances, exits, stairs, elevators, driveways, and any part of the common areas.
- Storage in Common Areas – No part of the common areas shall be used for storage or personal use. Any such items found within the building/property’s common areas are subjected to confiscation and subsequent fines.
- Posters, Signs, and Advertisements – Residential tenants shall not post any signs, poster, notices, or other advertising collateral on any part of the building/property’s premises. Any such items found within the building/property’s common areas are subjected to confiscation and subsequent fines.
- Items in Common Areas – Residential tenants shall not place any door mats, rugs, or the likes outside units or in any common areas.
- Weight restrictions on Fixtures – Residential tenants shall not place any object exceeding 50lbs per square foot in the units or in any common areas.
- Alteration of Existing Fixtures – Residential tenants are not allowed to remove, change, alter, or temper with any existing fixtures within the units or the common areas such as:
o Walls, ceiling, and floors
o Paint and/or finishing of walls, ceilings floors, and fixtures o Windows and blinds
o Main and bathroom doors and fixtures
o Electrical wiring, outlets, and lights fixtures
o Plumbing lines, toilet fixtures, and exhausts
o Smoke alarm and sprinkler systems - Obstruction of Windows – No objects or any items shall be placed between the blinds and the windows as to preserve the visual uniformity of the exterior appearance and aesthetic value of the property. All obstructions shall be subject to removal and subsequent fines.
- Door Locksets – Residential tenants are not permitted to change or alter the existing lockset of the units main door. The installation of a secondary lockset inside or outside the unit is strictly prohibited.
- Illegal Parking – Public utility vehicles shall not be permitted to use the parking facilities.
- Noise in Parking Areas – All motor vehicles of residential and commercial tenants should be equipped with suitable muffler or noise deadening devices. Smoke belching from vehicles is strictly prohibited within the building/property premises.
- Pets in Building – No animals are allowed to be kept or harbored in any residential unit or the common areas of the building and its premises.
- Guests – Visitors are permitted to visit lobby areas. Visitors are not permitted to stay or sleep at residential units.
Common Areas
- Elevators – The use of elevators are for the common use of the residents of the building. Maximum loads are indicated inside the elevators. Articles in excess of the maximum load shall not be allowed inside. In case the elevator is damaged due to the acts of negligence or vandalism by the resident, the cost and expenses incurred in repairing the damage shall be for the account of the concerned resident. Protective accessories for the elevators are available upon written request from the building management when moving in or out large objects that may cause damage. Smoking is strictly prohibited in the elevators.
- Obstruction of Common Areas – The common areas are intended and exclusively for the use and enjoyment of the all tenants. No tenant shall therefore obstruct the use of the common areas that are intended for ingress, egress, and access to any portion of the building. Obstruction or restrictions to entrances, exits, stairways, emergency escapes, fire escapes, hallways, verandas, driveways, parking spaces, or any part of the common areas are strictly prohibited.
- Storage in Common Areas – No part of the common areas shall be used for storage or for any other purposes incompatible with the original intent of the use of the common areas. The building management has the right to confiscate any obstructions found in the common areas of the building.
- Fixtures in Common Areas – All furniture, fixtures, devices, appliances and the like places in the common areas by the building management are exclusively for the common use in the these specific areas. No tenant shall be allowed to move or remove these items from areas which it has been placed by the building management.
- Obstruction of Windows – Windows, plant boxes, or any part of the common areas that is exposed to the public view must be free from any hanging objects. Installation of any kind of fixtures on the windows of the units and common areas of the building are strictly prohibited.
- Additional Fixtures – Nothing shall be placed in any unit or common areas which may impair the structural soundness, aesthetic value, and concept of the building.
- Approved Additional Fixtures – Unit residents or authorized representatives are required to give advanced written notice of at least twenty four (24) hours to the building management is they intend to move-in or out large items such as furniture, appliances, household goods, or similar items as to ensure the safety measures to protect the property and the common areas from damages that may incur while moving in or out.
- Loitering in Common Areas – Hallways and lobby areas are intended for theexclusive use of the residents only. Unauthorized guests are not allowed stay norloiter in the common areas.
- Solicitation – Business solicitations, dissemination of advertising media while inside the premises such as, but not limited to, distribution of flyers, leafleting, dissemination of business cards, peddling of merchandise or the like is strictly prohibited.
- Smoking, Alcohol, and Gambling – Smoking of tobacco cigarettes, E-Cigarette, Vapes, drinking of alcoholic beverages, and gambling within the common areas is strictly prohibited.
Use of Common Parking Area
- Clearance Height – The clearance height of the parking area driveways and parking slots in the lower ground floor is 2.2 meters
- Authorized Vehicles – Only Authorized vehicles are allowed to park in designated parking slots within the parking facility. All vehicles must register at the building management office and must be provided with a designated parking slot.
- Private Vehicles – Only private vehicles registered and owned by the residents or Lessee may park within the facility. Public utility vehicles are not allowed to park.
- Traffic Rules and Regulations – Drivers are to observe traffic rules and regulations appropriately. Speed limit must not exceed 15kph and directional signs posted shall be followed.
- Unattended Vehicles – Vehicles must be properly parked on designated parking slots only. No vehicle should be parked or left unattended at entrances, exits, driveways, and loading and unloading areas.
- Parking Etiquette – Vehicles must be properly parked in the parking slots provided without obstruction to other parking slots, driveways, and access areas. No vehicle should obstruct any driveways, sidewalks, loading and unloading areas, mechanical rooms, and other parking slots
- Double Parking – Only one car per slot is allowed. Double parking is strictly not allowed.
- Motorcycle Parking – Motorcycles are not allowed to obstruct or park on the entrances, exits, driveways, sidewalks, and loading and unloading areas. Motorcycles are not allowed to park in front, between, or at the rear of any parked vehicles.
- Repair of Vehicles – No vehicle repair work of any kind especially maintenance and tune-ups is allowed.
- Cleaning of Vehicles – Heavy cleaning of vehicles within the parking areas is strictly prohibited
- Storage in Parking – Parking spaces shall not be used for storage of any kind.
- Noise in Parking – Unnecessary or excessive noise from vehicles such as testing of burglar alarms, engine revving, and car horn blowing is prohibited within the building premises.
Safety and Security
Residential Key Entry – Keys issued to all residents or Lessees of the building shall grant them entry to their respective rooms. The keys issued will unlock the main door locksets of their respective room only. A set of keys are issued to each individual residing in their corresponding room. In case of loss of keys, kindly report to building management immediately.
Deliveries – Agents, vendors, or delivery personnel are allowed to enter the premises upon confirmation of an intended delivery within the premises or prior appointment with the resident. Verification from the building security will be made upon arrival of any deliveries. Agents, vendors, or delivery personnel are not allowed to go up the building. They will have the option to leave the package or goods at the lobby reception where the indented recipient or representative shall come down to pick up the pack or goods delivered.
- All deliveries to residents must be cleared first through the Building Management. No delivery service shall be allowed inside the residential floors. A Gate Pass Clearance must be obtained from Building Management for allowing the ingress of furniture, appliances and the like.
- Food delivery must be claimed by the unit tenant in the lobby.
- Cash on Delivery must be handled by the respective tenant. BuildingManagement cannot store COD payments on behalf of the tenant.
Denial of Entry – The building management reserves the right to deny entry to any unauthorized individuals into the building or its premises. Those will no official business or proper identification shall not be allowed entry inside the building or its premises.
Reporting of Unusual Activity – Any unusual occurrence in the building or its premises should be reported immediately to the building management office or security personnel on duty.
Inspection of Residential Units and Common Areas
1. Privacy – There is no guarantee of the residential tenant’s absolute privacy. The building/property management reserves the right to conduct scheduled inspections of the leased units. The purpose of the inspections is to ensure the tenant is in no violation of the house rules and regulations and for routine maintenance checks of the unit. The building/property management will need to schedule with the tenant protect the property and the common areas from damages that may incur while moving in or out prior to every inspection. During an inspection, management and the tenant must be present. Consecutive missed inspections will be subjected to fine and penalties.
- Search and Seizure – In proper cases, any tenant suspected of possessing illegal drugs, contrabands, dangerous weapons, and explosives shall automatically be subjected to a mandatory search of the leased premises. If the search is authorized, the tenant must fully cooperate. Jurisdiction will be handed to local authorities with the building management as witness during the unit search.
- Caught in the act – Prohibited or illegal items caught in the act of possession of and/or use by a tenant shall be immediately confiscated and turned over to local authorities.
Enforcement of Governing Documents
- All residential tenants must comply to the house rules and regulations. The rules and regulations for the use and occupancy of the building may be revised, modified, amended, or supplemented from time to time by the building management in accordance to local rules, ordinances, and laws enforced by local and national authorities. These rules and regulations may be amended and repealed at any time by the building management if deemed necessary for the welfare of all residents and the overall environment of the building.
- The building management has the right to file an injunctive action to enforce the house rules and regulations for any violations breached by a tenant. The violating party must pay for all the costs of the injunction including a reasonable attorneys fee which will be in no case less than P20,000.
- All residential tenants in violation of the house rules and regulations shall be subjected to fines and penalties. Such fines and penalties will reflect in the monthly dues and will accrue with interest if left unpaid.
- Tenants in violation of the rules and regulations will have to pay for expenses including attorney’s fees incurred by the building/property management for the enforcement of the house rules and regulations.
Violation and Fine Procedures
- Compliance with Building House Rules and Penalties for Violation – All residential tenants shall observe and comply to the building house rules, regulations, and such other reasonable rules as may be promulgated from time to time by the building management. All residential tenants must also abide and comply to the rules, regulations, ordinances, and laws issued by duly constituted local or national authorities regarding the use, occupancy, and sanitation of the units. Unit residents are duly responsible for any violations committed by their guests. Without prejudice to the right of the building management to impose the penalties provided in existing laws, declaration of restrictions, By-laws, and other provisions of these house rules to unit tenants who violate any provisions of the rules and regulations.
- Actions of the Building Management Office – In the event a unit tenant violates, permits, or allows the violation of, any limitation, restriction, covenant or condition of the building house rules, regulations and guidelines, by-laws of the building management, and such violation does not involve the obligation to pay money, the building management shall direct such unit tenant, as the case may be, by written notice to remedy or otherwise cease from continuing the violation within the reasonable period of time fixed in the notice. Through the building management office, the building administration or such other officer as may be authorized for this purpose, shall have the right to do the following:
- Enter a unit of the erring tenant/lessee and to summarily stop and remove, at the expense of the unit tenant, as the case may be, any structure thing or condition constituting the violation without incurring civil or criminal liability;
- Impose fines in accordance with the schedule of fines and penalties that may be promulgated by the building management, which fines and penalties shall be included in the assessments made against the unit resident concerned: and
- By appropriate legal proceedings, to enjoin, stop, or remedy the continuance of such violation or to otherwise enforce compliance with the pertinent provisions of the building house rules and regulations, guidelines, and the by- laws of the building managements.
3. Schedule of Penalties – The standard schedule of penalties that shall be imposed on erring unit residents and lessees of the building are as follows:
First Offence: Written Notice
Second Offence: Written Notice and P1,500 fine
Third Offence: Final Warning Notice and P3,500 fine
Fourth Offence: Evaluation of existing contract
The number of violations shall be cumulative over a period of 1 calendar year commencing from the date of the first violation.
- Liability for Expenses – The erring party shall be liable for any and all expenses incurred by the building management for stopping the violations, enforcement of sanctions, and the imposition of penalties thereof or the collection of unpaid dues including interest, cost of attorney’s fees, which shall be less that twenty (20) percent of the amount due and owing of Twenty Thousand Pesos (P20,000).
- Liability for Damages – Unit Lessees, Tenants, and Occupants shall be liable for any and all damages caused to any person, property, or Building Management and it’s authorized representatives, arising out of or as a result of any violation or breach of the Building House Rules & Regulations, By-laws of the Building Management, or the Master Deed and Declaration of Restrictions, as amended, which attributable to said unit tenants and/or their representatives.
Utilities and Service Facilities
Unit Key Access – Each Tenant shall be issued a room key for access to their corresponding unit. Room keys are not-transferrable. Duplication of room keys are prohibited unless requested from the Building Management at a cost of One Hundred Pesos (P100) each application. All lost keys must be reported immediately to the Building Management.
Roof Deck – Lessees, Tenants, and their authorized people are not allowed access to Building the Roof Deck located on the 8th floor. Access to the Roof Deck is strictly prohibited to all building residents.
Elevators – Tenants are allowed to use the two (2) passenger elevators in the building premises. The following are the general guidelines for the use and maintenance of the Building’s elevators:
- Smoking – Elevators are NO SMOKING areas.
- Load Capacity – The maximum load is indicated inside the elevators. Articles inexcess of the maximum loan shall not be permitted inside the elevators.
- Damages and Liability – In case the elevator is damaged due to the acts ornegligence of a resident or tenant, the cost and expenses incurred in repairing the damages shall be for the account of the concerned resident or tenant.
Service Elevator – A service elevator setup may be requested by a tenant for moving in or moving out of items that may cause damages to the said elevators. Furniture, sizable boxes, construction materials, debris, other heavy and/or voluminous articles must be delivered from the Lower Ground Floor and through the service elevator.
Gate pass and Work Order Permits must be obtained from the Building Management Office and approved by Building Management personnel prior to the installation and use of the service elevator.
Air Conditioning Units – The provisions for the air-conditioning equipment or units in the residential units (ie. the space and structure, the electrical load, cabling, connections and circuit breakers, the drain and other provisions) have been designed and optimized for the Urbanspace building requirements.
The Tenant shall be responsible for the general maintenance of their air-conditioning equipment. However, the assistance of the Building Management or its accredited contractors may be availed to undertake necessary repairs at the Lessee or units tenants expense.
Plumbing – The Lessee , Tenants, or their authorized people shall in no circumstance be allowed to work or alter any existing water, sanitary, fire protection, and plumbing system of the building and its premises.
Appliances and Electrical Equipment – All radio, television or other electrical appliances or equipment of any kind or nature, installed or used within each unit shall fully comply with all the rules, regulations, requirements or recommendations of the fire insurer and the public authorities having jurisdiction thereon. The Lessee or the unit owners, as the case may be, shall be solely liable for any damage or injury caused by the installation, operation, and use of any radio, television, or other electrical appliances or equipment within the residential units.
Generator Set load Limit – The building is equipped with a 50KVA power generator that supplies enough electricity to run the elevators, pumps, machines, fire safety equipment, ventilation equipment, and common area lighting. The power generator can also provide power to the residential units for basic necessities. Any such power exceeding the allocated back up power per unit shall cause the emergency breaker trip and to shut off for safety precautions.
Fire Detection and Alarm Systems – The building is equipped with a centralized fire protection sprinkler and smoke alarm system. These systems are present in all residential units, commercial units, parking areas, and common areas.
Fire Extinguisher – Fire extinguishers are located along the common areas of the building and inside the fire hose box located next to all fire exits. The use of fire extinguishers are strictly for emergency purposes only. Any unauthorized use or tempering of these devices are strictly prohibited.
Smoke Detectors – All residential units, commercial units, parking spaces, and common areas are equipped with smoke detectors. These are connected to a centralized system to detect early signs of fire. No tenant shall be allowed to remove, relocate, obstruct, or cover the said smoke detectors for any reason.
Tampering – There shall be no tempering with any of the fire detection and alarm systems (sprinkler, fire alarm, smoke detectors, hose cabinets, etc.) of the building. Any necessary alterations/relocations of these systems must be coordinated with Building Management.
Maintenance and Repairs
Building Maintenance Personnel — The maintenance personnel(s) of Urbanspace shall be responsible for the maintenance and repair of the common areas and units.
- All requests for service or repair must be coursed through the Building Management. Building Management shall decide whether the service being requested is one that our Maintenance Personnel can perform. The work then will be scheduled accordingly to the availability of the service personnel and the urgency of the repair work.
- No unit tenant are allowed to send any maintenance, security or any building employee out of the premises on a private errand. In any event that a need arises, the unit tenant may course his/her request(s) through the Building Management.
Sanitation and Garbage Disposal — Residents shall provide themselves, at their own expense, garbage containers which local ordinances and Building Management’s rules and regulations or guidelines require. Only garbage in tightly-sealed disposable garbage bags may be thrown in the building’s garbage disposal bin.
- Burning of waste materials, garbage, refuse or the like in any area of the building, whether inside the unit or within the common area is strictly prohibited.
- Residents must keep his/her unit clean, sanitized and free from any unpleasant odors.
- No garbage or trash shall be left in the common areas, or thrown from the windows, entrances, hallways, elevators, fire exits and stairways.
- Due care and diligence must be exerted at all times in making trash deposits in the designated garbage areas so there will be no litter/refuse in any of the passageways and common areas.
- Resident(s) and their guest(s) should ensure that all matters constituting fire hazards such as cigarette butts, matches and other flammable materials and chemicals must not be thrown at the garbage areas without being properly extinguished or contained.
- Building Management reserves the right to issue a Notice of Violation with corresponding penalties, subject to reasonable judgement as may be deemed necessary, on any violations committed by the unit tenant in relation to the items stipulated on Sanitation and Garbage Disposal.
Garbage Collection — Garbage is collected per at the Lower Ground Floor twice a day. Special garbage collection bins will be accessible at the floor landing for quick and easy garbage disposal. Garbage must be properly thrown inside the bin. Under no circumstance can the tenant leave the garbage bags on the floor, or around the bins.
Pest Control — The Building Management shall hire a contractor to undertake periodic pest control treatment on the Common Areas of the building against rodents, mosquitoes, vermin and other pests. Pest control services will be done simultaneously throughout the property to achieve optimum results. Tenants will be informed of the schedule of the said treatment prior to schedule.
- Tenants who wish to have their units serviced by pest control must coordinate with Building Management to acquire such services subject to a reasonable cost. They shall be informed in advanced prior to the scheduled pest control treatment.
- Tenants who avail of the additional pest control services must allow the authorized representative to enter the unit at reasonable hours of the day of inspection, and to undertake preventive measures to control or exterminate these pests at the expense of the tenant(s).
